    Default Unemployment Eligibility And Previous Job

    My question involves unemployment benefits for the state of: Illinois
    I recently filed for unemployment. I worked at my most recent job for 8 months from September 2007 through May 10, 2008. The business closed and gave a two day notice which I was informed of through a letter found with my paycheck. I believe then that I would be eligible, considering that I worked there for 8 months. I, however received a letter stating that I am being questioned over the phone of why I voluntarily left a job last year. I haven't worked at that establishment for almost 9 months. Why am I being questioned on a previous job that I had left that long ago, when the job that I previously worked at closed. Can I be denied because of a job that I quit 9 months ago. On the letter i received, of the four base periods, only one base period is with my most previous job, in which I only made $806.00 Will I be denied? I am confused because I worked two jobs last year and don't know the qualifications in my situation.

    Unemployment benefits are based on quarters. The quarter that applies at present is one from your past employer

    In most states, UI is based on the past four quarters, not just the current one.

    So is the unemployment eligibility based upon the job that I left in August 2007 or the most recent job? Does it matter that I only worked 4 months and made 806.00 in that time frame? I also worked another 4 months at that establishment in 2008, although that quarter was not mentioned in the letter that I received regarding my base period quarters. Am I still eligible? Why am I being questioned on the job that I left in August 2007? I am so confused and would like to know if I am eligible soon, instead of waiting another week. Does anybody know the rules regarding my situation. Thanks!

    Only the UI office of your state can say for certain. But you would be well served to answer their questions promptly and truthfully. They are far more likely to deny your benefits if they do not get the information they want. They don't ask questions for no reason.

    There's a lot of information about Illinois unemployment insurance available here, including this brief overview (PDF) of worker's rights and this handbook (PDF). I don't see within that anything that would suggest that quitting a prior job would disqualify you for unemployment benefits, provided you qualify due to the nature of your termination from your most recent job.

    There is the following statute, but I doubt it would apply based on what you have said,
    Quote Quoting 820 ILCS 405/601(A) - Voluntary leaving
    A. An individual shall be ineligible for benefits for the week in which he has left work voluntarily without good cause attributable to the employing unit and, thereafter, until he has become reemployed and has had earnings equal to or in excess of his current weekly benefit amount in each of four calendar weeks which are either for services in employment, or have been or will be reported pursuant to the provisions of the Federal Insurance Contributions Act by each employing unit for which such services are performed and which submits a statement certifying to that fact.

    Can you share any more details about the reasons for the "questioning", even if by calling the agency and asking for the statute or other authority they are applying?

    They should still be eligible for benefits from a previous job no matter what....

    That would be my feeling too but again, only the state can say for certain and the poster can only hurt themselves by refusing to provide the information requested.
