    Exclamation Boyfriend Charged With Possession With Intent Over Narcotics Prescription

    My question involves criminal law for the state of Illinois.

    My boyfriend was arrested this past Tuesday for possession w/intent. He went to a cvs pharmacy drive thru to pick up 90 norcos. When he gave them his name to pick it up they said hold on & about 2 minutes later the police show up & arrest him. The nurse that called in the prescription is no longer a nurse. When they arrested him, he never had the pills in his possession. They never gave them to him. Can they still charge him with possession even though he never had them on him? He has no felonies on his record. Just driving on suspended/traffic violations.

    He went & saw the judge for bond & the judge even said the intent charge didn't make sense. His bond is $2,500 (10%). We don't have that amount so he has to sit there until june 24th, his next court date. When he goes back to court, will the judge reduce his bail?

    We don't have the money for a attorney so he has been appointed a public defender. He doesn't even know the pd's name or has even met him. Any advice on how I can find out who his pd is & get in touch with them?

    Did he know the nurse was no longer a nurse when he received the prescription?

    He says he didn't know that she was no longer a nurse.

    Did he meet her at a location known to provide medical services, or make some "alternate arrangements" to get this prescription called in?

    He called her to tell her what he needed & she called it in, then went to the pharmacy to pick it up then the police showed up. They arrested him before he even had the pills on him. He had nothing on him when he was arrested.

    Not having the pills means nothing. He went there with intent to get them.

    No nurse (real or not) nor can any doctor call in such a Rx. It must be in writing on a doctors Rx form.

    90 pills can be a normal Rx however, it can NOT be called in over the phone.
