My question involves collection proceedings in the State of: Pennsylvania
Recently moved to PA. Wolpoff & Abramsoncontacted me regarding a debt that was not mine -- same name, but not mine. Harassing phone calls, letters, etc.
These people do not care about the facts, but are more concerned about coercing money from you, whether you are the party or not. I attempted to tell them I was not this person, but they fish for information. After reading up on them on the internet, I was very careful providing any information at all since they do not have a good reputation at all.
I sent them a letter via certified mail stating this was not me, denying the debt, demanding they stop the harassing phone calls, and to send me proof of the debt. I also told them I have never lived in the town they allege the debt was made.![]()
About 45 days later, they sent me a packet of what appeared to be billing statements. It had my name on it, but no middle initial. These were just statements, no contract or other proof of the claim. I assumed they sent this because I requested it to keep from getting in trouble on collection laws, since if they read my letter any conscious person would know it was not me.
Four months after they sent the information, they sent me another letter stating they intended to sue. I considered filing harassment charges at that time, but these feable minds are not worth the time. I did not contact them any further.
They filed a complaint in District Court. I am looking forward to my day in court. I have notified the court that I intend to present a defense and I am beginning my research.
I have read that one of their tactics is to file complaints and then either ask for continuances or not show at all. I want this matter cleared.
If an attorney shows their face in court they have got to be a jackass. They have done absolutely no diligence on this at all. I have done a breif search on the internet on the common name and if I spend $50.00 I can probably pinpoint exactly the person they seek. Again, this outfit is out there.
Questions:
1) Is there any way I can bring charges against them?? I would like to file a couterclaim against them so I force them to court to resolve this matter.
In the complaint, they verfify the facts set forth in the complaint are true and correct and the statements are made subject to penalties regarding unsworn falsification to authorities. I cannot see how anyone can make that statement after reviewing my letter -- Do I have any recourse???
2) Can I seek any damages?? This has taken so much of my time and has been very stressful.
3) What agencies can I contact to report what I consider gross negligence, particularly by a licensed attorney??
