    Default Can We Be Arrested For Salvia And Pipes Used To Smoke It

    I live in San Antonio, TX; bexar county and I share an apartment with my boyfriend and two roommates.

    Roommate #1 smokes pot on an almost daily basis. I was in his room not five minutes ago and he had a big bag of it as well as at least one pipe and a water bong.

    My husband and I do not smoke pot, but we do have two different pipes that we use for only Salvia.

    Roommate #2 forgot his key one day, while we were gone and swore that we were at home, locking him out (he claims he called maintenance and the police about this, but nothing happened). Since then he has been threatening to call the cops on both Roommate #1, as well as me and my husband.

    Since we do have the one water bong and small pipe, but they have never been used for anything but Salvia, which is legal as far as I know (we bought all of this straight out of a store)...Can we be charged for any of this?

    I was under the impression that as long as these were only used for the legal Saliva, that we were fine, but could we be arrested for this?

    Also, if Roommate #1 is found in possession and we are home at the time, are we guilty by association, with no recourse?

    I would be far, far more worried about this:

    ...and the fact that this seems to have gotten roommate #2's britches in a bunch.

    But anyway...

    The definition of drug paraphernalia is pretty vague, by design. So long as your pipes have NEVER been used for marijuana (they can be checked for residue), you're generally OK.

    The larger problem is your pot smoking roommate. If he gets busted while you're home, you very well could be nastily questioned at the very least.

    Have you considered moving out or getting rid of that roommate?
