    Default Tangled In Motions

    My question involves child support in the State of: Michigan

    In my case the non custodial parent received a settlement. It was ordered that 50% of the settlement be disbursed to child support for arrearages. The non custodial parent threatens the custodial parent to drop child support because of financial need. The custodial parent disagrees. At the disbursement hearing both custodial and non custodial agreed to the terms of the disbursement. Now the non custodial parent has filed an objection to the hearing to stall disbursement.

    The non custodial parent is:
    -not currently paying any support payments and is in arears
    -threatening to continue to stall disbursement unless the custodial parent agrees to stop child support

    The non custodial parent is purposely filing motions to impeede the disbursement. Is there anything that can be done to stop this?

    A motion to establish paternity was filed. The non custodial parent is claiming that the initial paternity test (taken in 1999) is inaccurate even though the state administered test results are 99.99%.

    and...

    A motion to stop and return child support payments to the non custodial parent.

    Those sound like frivolous motions. Ask your attorney about filing a motion to dismiss the motions as frivolous motions and ask for court sanctions if the problem continues.
