    Default Cafeteria Plan 125

    My question involves labor and employment law for the state of: Arkansas.

    When an employee is signing up for benefits that qualify as pre-tax...Dental, Vision, Health, etc. Must they be pre-tax or can they chose to use after tax dollars. Also, can they cancel their benefit during the year if they have paid for the benefit with pre-tax dollars?

    They can choose to use post tax dollars (though I can't imagine why they would) IF the 125 document allows for it. And only if.

    Federal law prohibits changes to the coverage on a 125 plan during the plan year unless it is within 30 days of a qualifying event.
