    Default Changing Son's Last Name In Ohio

    My question involves name change laws in the State of: ohio

    My x and I were not married or even a couple when my son was born, in fact I didnt even really know about him till I got a DNA summons.When he was born she gave him her last name. I have been proven to be the father and i pay child support and provide extra things for my son but my question is can I have his last name changed to mine even if she doesnt agree with it? She has another child and gave him his fathers last name so I dont really know why she insists that my son have her last name.

    No. She has to consent.

    The court requires that the change of name show a benefit to the Petitioner (the person whose name is to be changed) - you wanting the child to have your name because you're paying your legally ordered support isn't enough for the court to ignore the wishes of your ex.
