My question involves landlord-tenant law in the State of: AL

Almost 11 months ago I paid a year of rent in advance. My wife and I thought we may be purchasing the home at the end of the lease and wanted a fence put up in the backyard. The owner agreed to put up the fence provided we paid for the materials ($1500). After living in the house we have discover that the owner/builder did not seal the foundation correctly and water is seaping up through the would floors leaving black stains and what we suspect to be Black Mold - repairing this issue would make the home unliveable until it was completed.

My questions involve 1: is the fence legally mine to take with us when we move since we paid for it?

2: We are planning on moving the end of this month because the Black Mold is affecting our health - do I have any legal rights to demand a refund of the unused rent?
