    Default Quit, Then Fired?

    My question involves labor and employment law for the state of: Texas

    When I accepted a position at this company, I signed an employment agreement that had stipulations for my at will employment. It stated that if I terminated my employment I would give the company 6 weeks notice. If the company terminated my employment, except for cause, they would either give me 6 weeks notice or if their determined termination date was less than 6 weeks notice, would pay me severance ending 6 weeks after notice.

    Five weeks ago I gave written notice of my resignation, stating that my last day would be May 30th. Through out this time there were allusions to wanting me to stay longer. Last Thursday they requested that I take a vacation day this week in exchange for me coming in one day past my resignation day. I responded that that wouldn't work with my schedule. The following day the HR director joined a meeting with my boss and said that they decided that today would be my last day.

    I then met with the HR director privately, turned in my keys and reviewed some HR issues. During that meeting she let me know that this was her decision because she watched things like this get really bad in the past. Evidently the founder didn't like that I denied her request. She then said that I would be paid through that day and not through my notice period, essentially then, my final paycheck would be minus one week's pay from what I had expected.

    My question is, do I have any claim to the weeks pay, given that I gave them six weeks notice, and up until that day thought that I would be working the full 6 weeks? Another question, even though I quit, it sure felt like I was being fired. Would I have any claim to have been terminated by the company?

    Since we cannot read your employment agreement from here, we don't know.

    Show it to an attorney in your state.
