    Unhappy Family Visits While Child Is In Foster Care

    My question involves a child custody case from the State of: FL

    My great niece (5 years old) is in foster care in FL. She had been in the care of my daughter since birth and considers me her grandmother. My daughter is currently in prison and my niece has had her parental rights terminated, so my greatniece is adoptable.

    The first foster family she was placed with were friends of ours, so I had unlimited visitation with my great niece. Last September, she was moved to another home and I haven't seen her since. Calls to her social worker go nowhere. The worker is never available and never returns my calls.

    Do I have any legal rights to visitation? Do I need to hire a lawyer to force DCF to let me have visitation? It has been almost 6 months since we've had any word of where she is, and we're very worried.

    Why is your daughter in prison? Why wasn't the child placed with you when your daughter went to prison?

    My daughter is in prison serving 10 yrs for felony child abuse. She'll be released in 2015. I couldn't pass the home study to have the child placed with me. I don't have enough room.

    Quite often DCF will allow visits. However, you'll definately need an attorney because your daughter's crime, and your inabilty to pass the home inspection, will unfortunatley make it extremely difficult to win your case.
