My question involves collection proceedings in the State of:
California.
I have been sued by a lawyer representing a company who bought my credit card debt of $5000, for $250. I have asked for validation of the debt, because the debt is out of statute ( 6 years here in calif.), but the plantiff's only proof of validation is a false affidavit, and one old credit card statement. The lawyer has not provided any proof of the date of default.
They have tried to serve me a summons but have been unsuccessful. The filing indicates a date in Aug of 08, for a case management review conference. If I have not been served as of that date, what should I do?
Should I still appear, or will the judge just dismiss the action based on the fact that no proof of summons was issued?
