    Default Same But Different

    I am in the process of marketing a magic effect which uses a memory system based on mnemonics. Since the M in mnemonics is silent, I thought that a catchy name would be Captain Mnemo. I did a Google search and discovered that a software company is already using that name for one of their products. My next thought was to call it Finding Mnemo but I'm afraid that the folks at Disney might take offense. Is the spelling difference enough to keep me out of hot water with Disney or should I use my creativity to come up with a completely new name?

    I would avail myself of the services of a Trademark attorney for an hour to make sure that ANY name I choose doesn't tread on someone's toes.

    Personally, I think your name is cute and unlikely to be confused with the movie, but Disney has deep, deep pockets and wins a lot of unlikely suits as a result.

    Disney is rich, incredibly protective of it's IP and, in association with that, not timid about taking legal action.

    Two points well taken. I'll avoid a confrontation and consult a trademark attorney. I don't want to have to re-tool because of a silly name.
