Emancipating My Child

My question involves emancipation laws for the State of: Florida

My son is about to turn 16 and is into drugs, flunking out of school and his father and I share parental custody. His father wants him emancipated due to his behavior and his knowledge of our son being in gang affliated. Can he do the petition without my approval? Is this something a judge might consider? I believe my son would want it but I do not. Please help.

But does that mean that he would have to prove my son can be self sustaining? If he's not he cannot be emancipated?

Even the absolute hardest working, cream of the crop, above-board kids have only a snowball's chance in hell of being emancipated. It's all about being able to prove a track record of responsibility and self support (not what you MIGHT be able to do tomorrow - but a history of what has already been accomplished towards becoming a responsible, productive, self supporting citizen). Any ONE of several words in your post are enough to throw the whole thing out the window (drugs, flunking, gang...etc.)

Based on the info in your post, I see no way a judge will emancipate your son.
