    Default Does Employer Have Obligation To Allow You To File For LTD Benefits

    My question involves labor and employment law for the state of: CA

    I developed a disability while working at my employer. I asked about going on disability beacause I felt that I could not work. DO they have any obligation to give me an application so I could file?

    They chose to lay me off.

    Are you talking about STATE disability? Why didn't you just obtain the application from either your doctor's office or get it on your own?

    That other thread was mine. Apparently those guys think I don't have a case. However commonsense tells me if you get sick, are dizzy and nauses and can't think straight that HUMAN RESOURCES should provide the resources for applying for some insurance policy that only HUMAN RESOURCES are aware of and is not in the manual. I highlight "human resources", because the name implies that they are supposed to be a resource for humans?

    No. Your employer is not obligated to keep you employed long enough to qualify for LTD benefits. Nothing in the law says that your employer has to keep you employed when there is no job you are able or willing to do, until you will qualify for a better benefit package.

    There is a miscommunication. Its not about staying around long enough to "quailify for a better benefit package". I get the idea. looks like there is two of you answering questions, we have been thru it. You don't see an angle. Thanks

    If you're looking for an "angle" to force your employer to do what you want, no, you're right, I don't.
