    Default re-entry possibilities after a voluntary deportation

    HI-
    My boyfriend applied for voluntary deportation(he overstayed his visitor's visa) and has returned home. Our understanding was that he had to wait 10 years to return although exceptions may be made if he were married or planning to marry a citizen. We have kept things kind of low key, not knowing for certain what the chances of him being able to return are and I don't want to live in his home country. We don't want to continue down a road to find a dead end! We have talked about getting married...but both feel we need to spend some more time together before making that final decision. What are the possibilities of him returning as a Fiancee? or would we definately have to be married before there was any hope of him entering ...and what is the time span?


    I am waiting to hear back from his lawyer, but would appreciate any general advice/knowledge on this dilemna!

    I don't think that there is any realistic chance of his getting a fiance visa under the circumstances. What did his lawyer say?

    I am having difficulty getting in touch with his lawyer.

    What do you think the chances are of him being able to enter if we were to get married in his country? He is not looking to become a citizen. Can you give me an idea of what the process is...and time period? I appreciate your comments!

    If you were married and could qualify for a hardship exception, the USCIS might take a look at the case; but it's not supposed to be easy to get around a deportation and period of exclusion.

    If the lawyer is your boyfriend's lawyer, not yours, perhaps your boyfriend can get a faster answer. If you're not the client, the lawyer would ordinarily be unable to discuss details of the case with you.
