    Default Statute Of Limitations

My question involves collection proceedings in the State of: california

the statue of limitations is over in my state for a cc debt. injured and income cut in half was problem etc. anyhow, we are moving to another state where the statue of limitations is longer. my question is: can they now come after me in the new state even though the time pasted while living in CA? Thanks!

    Default Re: Statue Of Limitations

It's possible. The Fair Debt Collection Practices Act does allow a creditor to sue in the state where the debt incurred/contract signed or the state of residence whichever has the longest SOL. It's according to the state & that state's law. Some states have a "borrowing statute" regarding when an out of state SOL can apply.
