    Exclamation Domestic Battery 3rd Degree

    My question involves criminal records for the state of: Arkansas
    I took a plea bargain from the Prosecuting Attorney of Domestic Battery 3rd Degree; Class A Misdemeaner. Which included 1 years probation (which ended April 9,2008, 6 months Domestic Violence class, court costs and fines and also "Act 531 if eligable". Which was described to me that the requirments were everything listed above. I have completed everything and have tried to get this expunged off my record. The Prosecuting Attorney, says that this is a Violent Offense and they don't sign off on these to be expunged. My lawyer that I was using to file the papers, says that there is nothing that I can do to get it off my record now that the Prosecuting Attorney will not sign off on it. I have been told that this charge on my record will not allow me to own or possess any firearms ever.

    I guess what I'm asking, is there anything that I can possibly do to either get this expunged off my record or at the very least get my gun rights back????


    Please help, I'm at whits end....

    DV charges are usually not eligible for expungement.

    In terms of eligibility, Arkansas Legal Services offers online worksheets. If the prosecutor is the holdup, though, the issue isn't eligibility but is instead the prosecutor's policies.

    High I have a record also but my crime if for worst than yours. I was locked up for aggravated robbery and served 7 years. I was 16 at the time and I did not get out until I was 23. I tell (cops, detectives, correctional officers, and even talked to the commissioner and all mentioned that I should get a pardon, even if I didn't bring it up. My main thing is character I work and have certificate in HTML and I graduate with an Associate of Specialized Science Degree In Computer Information Systems in December. So I think you should first build character such as I have and when they see that you are doing good and your back ground could stop you from getting the job you are going to college for they will be on your side. It is all in the character. Use google and do some research on getting your record expunged in Arkansas. You will see that you are eligible for expungement. The only ones that are not eligible are quote

    Under Arkansas law, the following are the crimes that can not be expunged.

    1. Any conviction that involves a minor,
    2. Any conviction that involves sexual assault,

    If you have been convicted of a crime that currently cannot be expunged, your best recourse is to contact your state senator or state representative and appeal to them to propose a change in the law
