    Default How Long Does A Criminal Charge For Identity Theft Stays In Your Record

    My question involves criminal law for the state of: NEW YORK

    I WAS ACCUSSED OF IDENTITY THEFT AND I PLEAD GUILTY, ALL I HAD TO DO WAS PAY THE COMPUTER BACK TO RESTITUTION. THAT WAS IN 2004 AND I FINISHED PAYING IN 2006, NOW I'M APPLYING FOR A JOB AND I WOULD LIKE TO KNOW HOW LONG WILL THIS BE ON MY CRIMINAL RECORD?

    Unless it is expunged, forever.

    So You Mean That An Employer Can See That Forever, There Is Not A Time That It Will Go Away In The Public Record?

    Yes, that is what forever means.

    Unless you have your record expunged (and you can't always do that), it's there for good.

    If you have a criminal record, and your employer conducts a criminal history check, you can expect that your criminal record will become known to your employer.

    Miss Francis, you say your "were accussed" in your post. We're you "convicted?" Did you sign a plea bargain for a specific charge or get found guilty in a trial?

    Some courts stipulate that you agree to restitution and defer any prosecution. Did you reach an agreement with the charging agency to perform restitution so that charges would not be filed? Also, were you an adult or juvenile?

    If you were convicted of a charge (as an adult) it will remain on your "rap sheet" for life and the restitution was a mandatory condition of your probation.
