Hi, here is my case.
I came from Chile to work as an intern to USA last February.
The company offer me to work until August 15, 2006. but in november 11, 2005 the company closed the facility where I was working and Fire me.
I have a letter that the company send to the Department Of State, where they specify my weekly payment, the location where I had to work and the dates.
the HR guy says that we was Interns, so we were not employee, and that our contract is at-will, so they does not have to pay. NOTHING.
Well, as I'll not continue working in the company, my J1 visa expire, so I have to go back to Chile. I have to pay extra fee buying the airplane ticket due to I have to fly soon.
I paid the fees for the visa Issue, and I'll lost that money.
Could anybody recomend an attorney to take the case?, for now I do not have money so it have to be contigency. the case is in santa clara county, San Jose, California.
How much time I have to sue the company? I'll go back to chile in 3 more days, (to work and get money) but I'll hope to came back soon to sue the company.
I'll appreciate any answer.
