    Default Unwanted Companion

    My question involves a roommate in the State of: Texas

    My estranged mother is 87 years old and suffering with dementia and lives in Texas. She has a male companion that has lived with her for the past 12 years in a mobile home that she owns and pays the space rent for each month. The male companion sexually assaulted her, he was arrested and is out on bail. My mother is being helped by Texas Protective Services and is in a nursing home until things can be sorted out. The male companion is back in her mobile home and he is not on the space rental agreement or paying any other bills that I know if. They do not pass the test as having a common law marriage. Can he be forced out of the mobile home or does the male friend have any right to remain in the mobile home? I plan to get guardianship and durable power of attorney so I can make the decisions that she needs to protect her and her property The Protective Services ask me to wait two weeks before contacting my mother, to give her doctor a chance to get her medication stabilized. I Live in California and will be going to Texas to help her anyway that I can as soon as they think it’s ok to see her.

    OMG - am I understanding correctly?? The man who sexually assaulted your 87 year old mother was allowed to return to her home after posting bail

    This can not be right!?!? I wish I had legal advice to give - hopefully this post will get bumped up higher on the board to attract more attention from someone who can help. I should think there would be a restraining order given as a provision of his bail I'm really sorry for your situation! I hope your mom is recovering...

    Yes. She (or you on her behalf once you are granted the DPOA) needs to initiate formal eviction proceedings.

    Then get a protective order.

    I suspect that's because she's not in the home, and thus his presence is not a threat to her.

    Texas Protective services put her into a nursing home, other than the dementia they say she is in good health but it's not likely that she will be able to return to her mobile home. I just talked to the police in her town and was told that I would have to contact the county attorney about getting him out of her mobile home. I guess it’s not a common situation and of the people I have talked to in the last two days, no one seems to know for sure how to handle it. I’m going to call the County Attorney in a few minutes.

    Thank God! It sounds like they are just making sure to cover all of the bases to make sure he is treated 'legally'. Please follow Missy's advice to get him evicted.

    Just talked to the County Judge's office and to the Justice of the Peace in my mother’s town. They said that I would need an attorney to handle the eviction and get power of attorney for me.
    The landlord of the MH Park is also talking to their attorney about getting him out! Looks as though nearly anyone can act as my mother’s agent in the eviction, so I'm working on that too.
