My question involves collection proceedings in the State of: New Jersey. A collection company is taking me to court over a credit credit I opened eight years ago. I know the SOL starts from when the intial date occured, but how do I know when that was. Is there a way that I can find out so I know if the SOL has expired. I looked on my credit report, but it didn't list that information.
The SOL on credit card debt is 6 years in NJ. The SOL starts from the date of last activity (ie date of last payment). Are you saying the credit report doesn't show date of last payment - did you request more than one credit report? Do you believe you made a payment within the past 6 years? If the SOL has elapsed, you needed to put that in your reply (answer) to the summons in order to be able to use that as your defense in court.
