    Default Minor Shoplift At TJMaxx In Massachusetts

    My question involves criminal law for the state of: Massachusetts

    My daughter was an employee of the store age 17. Got caught stealing, faced mgmt was scared sign note saying she would pay over $1,000 back for stuff she took over 6 months. Parents were never called, police never called.

    Legally is her promissary note valid if she was 17. They thought she was 18.
    Should parents of minor been called.
    She was never given a list of stuff stolen, only told it was on video tape.
    Sounds like she was intimidated, scared and just wanted to get out without us(parents) finding out.

    Now they want the money and we found out

    If you're asking what will happen if she chooses not to pay TJ Maxx back for the stuff she stole, the only way to find out is to decline to pay. If she get's charged with felony embezzlement, you'll know you made the wrong choice.

    In Mass, 17 is an adult. TJMaxx's policy is to make an attempt to contact a parent of a juvenile before speaking with them. Legally, because this is Mass, and she is an adult, they do not have to contact anyone.

    More than likely, she was not spoken to by management, she was spoken to by a Loss Prevention Internal Investigator, who knows all Mass laws and TJMaxx policies regarding Internal Theft.

    They do not have to give her any paperwork, or show her any evidence they have, such as a list of the items she took or the videos.

    If she does not pay the promissory note, or make any attempt to pay any of it, TJX will take her to court. If she can't afford the amount she told them she'd pay, call the corporate office in Framingham and speak with someone there. If she can afford $20 a month, they'll accept it. If she ignores it, it won't go away.

    Shamrock, to clarify, by adult you are referring to the 17 year old not falling under the juvenile court system?

    Just so others that read this don't confuse 17 to mean that the minor is a legal adult. In Massaschusetts, "Adult'' shall mean any person who has attained the age of eighteen.
