Long Story... Sorry.
I recently purchased a piece of property in St. Louis MO with the intent of building a home. Our lot was divided from an estate containing 3 plots. Ours (vacant), one behind ours (vacant) and one to the west (containing the estate home)
In doing the survey during the purchase it was discovered that the boundary between our vacant lot and the lot with the existing home ran directly through the home's U-Shaped driveway. This does not cut access to his garage or home, just to the turn around portion. The buyer of the home asked for an easement at the time of sale, however we had no idea what we were going to do with the property and did not know how that area was going to come into play.
Turns out. Our property also has no sewage access. The best and least damaging way to a main is through his property. Today I asked for that permission. He obviously asked for an easement for the driveway as a sort of property trade.
I told him that I would not want the liability of having his driveway on my land and that the trade was not true because he would not be granting the land to me but to the local sewage district.
If he refuses to grant easement, what are my options? The lot to the rear of us will not grant easement because of damage to existing trees so he is our only option at this point.
