    Default My Boyfriend Is An Overstay But I Can't Show Financial Support

    My boyfriend of five years (we have a 4 year old child together) has been entering back and forth to the U.S. on a visa waiver program to spend time with us for 3 months at a time. This time, he has overstayed his visa by 1 year. We already got an extension once. Now I understand he faces the 10-year ban. My two-fold question is this:

    Could we ostensibly get married here even though he has overstayed a year? And-- would we even qualify to marry since I cannot show financial support of him (I checked the poverty guidelines and I don't earn enough)?

    Yes, you can get married and file to adjust his status. Here is a link to immigration through a family member (Spouse)..

    For the financial support, you could look into finding someone else who might be willing to file the affidavit of support. Parents, brothers, sisiters....
