    Default Employer Not Paying

    My question involves employment and labor law for the state of: Georgia

    I have been with my employer for about a year and a half. When I first came to work for them my offer letter stated I would work for a reduced salary for the first year with an $11K bonus paid January of 08. My pay was also raised in January to the level we had agreed upon.

    So far they have paid me 5K of my bonus as I did agree they could pay the last 6K by the end of the first Quarter. The company is struggling due some miss management which they fired the President for. They have been late on several paychecks with the promise they would have the issue fixed.

    My last two paychecks they have withheld 700.00 on each of those. Now my employer is giving me the choice of amending my employee agreement by changing my pay structure. The other option is they eliminate my position The pay adjustment would amount to 2K per month.

    What can I do I need the job but I can't pay my bills with this type of cut.

    Unless you had a written contract - not an offer letter- stating otherwise, they may, in fact, adjust your pay.

    I hope the job market in Georgia is better than the one here in Ohio, because your best option is to abandon ship and find a new job.

    If it were me I would find another job as mismanaged companies usually fold. Once you leave an employer they have 30 days (I believe it's 30 in Georgia) to pay you all monies due and owing. You can go to the "unemployment office" and file a claim against them or hit them with a small claims charge.

    It wouldn't be the unemployment office to file a wage claim but the DOL. Georgia's DOL laws are very weak but you can file with the federal DOL or sue in small claims court. Suing in small claims court would probably be your best bet.

    If you decide to quit, Ga. has no law as to when you must be given your final paycheck. (no set deadline when employee must be given final check)

    It seems your only options are to continue working there or look for other employment. Your employer can, without a bona fide employment contract to the contrary, change your pay structure.

    Thanks for your answers some of that I already knew I guess this is not my month as I was just informed yesterday that I now have an pending divorce to deal with now as well. When it rains it pours I quess.

    My biggest contention on them changing my wages is the fact of the money that is already owed me. I would much rather just collect what they owe me and move on. Currently that is about 10K since my insignificant other has opted out I think it is time to just move on. I know Georgia's laws are weak and favor the employer and stickes it to the worker. According to the FED DOL all money's owed the employee come due on the next scheduled payday.

    However they told me I would more than likely have to end up taking them to court. My plan is to just wait it out until something better comes around I found another part time gig that shoudl make up the difference. I am currently 50 years old and the job prospects in management these days aren't real good for my age bracket I will make it through it as I always have in the past.

    For your info - you can sue in small claims court in Ga. for up to $15,000. (if you go the small claims court route)
