    Default Can New Spouse Be Liable For Premarital Property In Foreclosure?

    My question involves a foreclosure in the State of: florida
    i have a home in foreclosure that i purchased in 04. i received an unsolicited offer for cash out refinance in 4/06 which i took. i refinanced for $89k and got $44k cash out. i got married this january 08 and was served notice of foreclosure 3/08. is my new spouse liable for my debt ? can the bank go after his property and wages even if i assumed this debt alone before i ever knew him. i dont want to save the house, i just want out of it.

    Obviously he's not on the loan. Did you have him put on the deed?

    No?

    Then the bank has no business even trying to go after him.
