    Post Children's Retirement Benefits.

    My nine year old has been collecting Retirement benefits from her fathers record for 3 years now. He and I were never married. We have never lived in the same home. Can I collect benefits from his record since I am the one caring for our child? I am her only caregiver, She lives with me 100% of the time. The only support from him is the monthly benefit she gets every month. As a matter of fact he has not seen her in eight years. I have called SSA, and the young man I spoke to hinted that someone is already collecting that benefit. He would not give me much info, because it is not my record. Is her father able to do this? If this is what he is doing?

    Also, I was just approved for SSDI/SSI; If I can collect from his record, will this affect my benefits?

    Her father and I live in the state of GA.

    Friends are not eligible for retirement benefits from their friends.

    In other words, no.

    Funny, you said that, I have went to my local SSA office this morning, and they not only told me that I could, But the also allowed me to apply for them. The nice young lady told me I will be able to draw these benefits till my 9 year old turn 17. That it did not matter if my child's father and I were not married.
    I guess your answer was clouded by your personal beliefs, Which I respect by the way. But you were wrong.

    No, actually, my response and my opinion came directly from the SSA Website, which I suggest, before you make snitty remarks, you go and read yourself: http://www.ssa.gov/pubs/10035.html

    Benefits for family members
    If you are getting Social Security retirement benefits, some members of your family also can receive benefits. Those who can include:

    Spouses who are age 62 or older;
    Spouses who are younger than 62, if they are taking care of a child entitled on your record who is under age 16 or disabled;
    Former spouses, if they are age 62 or older (see “Benefits for a divorced spouse”);
    Children up to age 18, or up to 19 if they are full-time students who have not yet graduated from high school; and
    Disabled children, even if they are age 18 or older

    In which category are you? You aren't a spouse, you aren't an ex spouse. You are simply the woman who had a baby. Just in case you didn't know... applying for a benefit and being approved for a benefit are completely different things. People can (and do) apply and are denied daily. I wouldn't cash your check before it comes.

    I clearly asked, and was told I could collect, because I was the women who had his baby, and I care for her. I believe the term they used was "It does not matter" Just as if my husband adopted her and she could still collect off of his record. You know as well as I do If i could not collect they would not have let me apply for benefits. Lastly "my snitty" remarks was only in response of yours. I asked a question, and you answered the question not before you added what was nothing but an passive aggressive insult. Do not serve, what you are not willing eat yourself. I got my answer that I needed here. So do not brother to respond, for I will not be back to read it.

    Actually, I happen to know that they will allow you to apply all day long... they'll deny you on the back end.

    Just like in my line of work. I allow people to come to my courtroom and file things all day that I know darn good and well won't fly. Sometimes a hard head makes a soft behind.
