    Default Breaking My Lease

    My question involves landlord-tenant law in the State of: Florida
    I moved to a brand new condo for 5 months and I have had numerous of problems with my neighbors and acting landlord. They make excessive noise over our heads all day till 2am the next morning. Kids running, the adults are stumping and playing loud music. I have called the police several times and nothing has been done and the landlord made comment that I just can move out, I gave a 60 days notice. The dishwasher has never been plugged up and we have a short in the wires and none of the issues was adress and now they told me they will file a judgement against me if I don't give them 1/2 of the rent but they never gave me notice or court papers but I did give the 60 days notice and forfited my deposit. what's my legal defense ?Please help!!

    Examine your lease carefully. What does it say about breaking your lease?

    Generally speaking, your lease is supposed to have a clause explaining how - and if - one may terminate the lease early and what the fees may be.

    Did you ask for repairs in writing? Or call a repairman yourself and send the landlord the bill?

    Usually, the problems you describe are not sufficient for breaking a lease without repercussions. You can be held responsible for the entire remaining term of your lease.

    There's nothing in my lease stating about breaking my lease. When I complained about the issues in Jan 2008 she said I was a difficult tenant and she she's not dealing with anything and I can move out and forfeit my security deposit. She told me to give her a 60 day notice and thats what I did. I gave her 5 months to correct these issues.

    You are responsilbe for rent for entire term of lease or until dwelling is rerented. If landlord says you can leave early find out the terms of early move and get it in writing

    I have all my documents and witness that heard the acting landlord tell me we can move out. So I'm just going to let the courts handle it.
