I live in the state of NY, and in most cases obey all the rules of the road. However, roughly three years ago I was issued a ticket for not wearing my seatbelt at what I would call a checkpoint. I explained to the officer that I was in a rush and I apologized for my actions. I was in the process of taking my girlfriend to the hospital ( under the impression she had somehow gotten metal in her eye ). Instead, he instructed me to pull over to the side of the road where I sat for 30 minutes waiting for my ticket. Upon my arrival home, I select not guilty and mailed the ticket in. Three years later, I now finally get a summons to court which I will attend. However, can they still hold this violation against me?
