    Default Father Doesn't Pay Child Support

    My question involves child support in the State of: South Carolina

    I'm 17, work 2 jobs, go to school, and live with my mom and stepdad. My parents have been divorced about 10 years and my dad has never consistently paid child support. He gives my mom about 300 a year for me. It doesn't cover medical bills, food, clothing, or any of the basics. I see my mom struggle with bills and she lives from paycheck to paycheck while my dad cashes in on my stepmom. My mother has threatened several times to take him to court, but never does. Can I take him to court for back child support? I don't believe any court would have sympathy on him for half the things he's done to me throughout my childhood. (He never molested me or anything like that so don't think that.) My mother does not keep me from seeing him nor has she ever. What do we do?

    Your mom needs to contact your local child support office. Please tell her to STAY AWAY from SUPPORT KIDS or any of the other private child support collection agencies. She needs to take him to court or go to your local child support office to file the paperwork. I don't know the laws of your state, but check to see if it's not too late to file for support. In some states once a child turns 18, that may be the cutoff as far as continuing support payments but if she never applied, I'm not sure how that works. If there is no statuate of limitations to file, there may be a chance that support may be retroactive . Good luck to you and your mom. I certainly hope it's not too late to file. Call your local office ASAP to get accurate information.

    No. It's not your money and it's not owed to you so you have no legal standing to bring a case against him for back child support.

    Your mother has legal options to enforce the current order. She obviously knows what they are since she's threatened to take that action, however, since she's failed to do so, then she'll continue to struggle and obviously it's not that bad for her or she would do something about it.

    You shouldn't concern yourself with adult issues.
