    Default Stuck in divorce negotiations over spousal maintenance

    My soon to be ex-wife and myself have been seperated for 10 months now and have reached an impasse. She is the person wanting the divorce and now is dragging her feet to finish the paperwork. We recieved one of those online divorce kits and have both filled out our respective sides. I think what is holding her back is the fact that she wants maintainence. She has a Masters degree and a preschool teaching job and I feel she does not need any extra money. We have three kids that we share custody of. I see them every other weekend. I have agreed to pay $1250 a month for support on my $4100 net income with $200 that i pay in insurance, but she wants more. The financial stuff is covered, like the house and all the shared belongings and debt. What can I do to push this along without getting a lawyer involved?

    Default Graduate Degree

    I'm not sure about Illinois, but many states regard a graduate degree earned during the course of a marriage to be a marital asset.

    If she earned her Masters degree during your marriage, see if the book contains a passage about a graduate degree as a marital asset subject to division in divorce. She may be more willing to forego spousal support if it is in trade for your giving up any claim to the value of her degree.

    Default Earned before marriage

    Unfortunately, she earned the degree before we were married. She has not held a full-time job for the last 10 years of our marriage so she says this is why she deserves extra money per month.

    Default Spousal Support

    How long will it reasonably take her to be able to return to the workforce in her profession?

    Default spouse return to work

    She is already teaching again in a preschool but only making 700 a month and no insurance.
