    Exclamation Terminating Child Support At Age Of Emancipation

    My question involves child support in the State of: Florida

    I am in the middle of an Administrative Proceeding with the DOR.
    **PLEASE NOTE THAT THIS IS DIFFERENT FROM COURT PROCEEDINGS-THINK ABOUT THIS BEFORE ANSWERING!**

    I have a few questions:

    How do I request that the child support cease at the age of emancipation?

    I received a proposed order, but the income for the custodial parent is incorrect (she lies on EVERYTHING-and is dumb enough to post things online about how she has under the table jobs). She has posted that she is going to work at a hospital-can I call the hospital and ask them if they have an employee there by that name? Should I explain the situation? Or should I just call and ask if "so and so" is there?

    If she is working at this hospital, she will have medical insurance. I do not have access and the proposed order stated that it is not reasonably affordable to me right now. If I find out that she is working at the hospital, should I request that she pay benefits?

    I need these answers quick because I only have 10 days to file and informal review and today is the 10th day.

    As always, please keep all answers detailed, but to the point and leave out personal remarks as they are not helpful.

    Nothing like taking care of things at the last minute eh?

    I suppose you can just disagree with the interim order, and ask for a judicial appeal...if you still have time to do that.

    At the very least it will buy you more time to do your homework.

    I'm confused about why you would ask about terminating a support order based on the age of emancipation, and how to contest the earnings of the CP in the same post.

    If your kid is emancipating, let's say in June of 2008, then your request to revisit the CP's wages seems to be mute.

    If you still have, say 10 more years of paying, then I would worry about a termination order 9 1/2 years from now.

    Anyone can call any business and ask if someone is employed there.
    However, the business is not required to confirm or deny anyone's employment status.
    I would certainly not suggest you "explain the situation".

    How do you know anyone who works a the hospital receives medical insurance? and how do you know that their children are also eligible for this benefit?

    It is normal for the parent who provides the insurance to have this amount accounted for in the support calculation - so regardless of who 'pays' the cost is actually split... so it is 6 of one or 1/2 a dozen of the other.

    Verify that the order won't expire automatically upon the age of majority. If it will not, you petition the court to end support based upon the child's reaching the age of majority (assuming no provision for support past that age).

    Do what you want. They'll almost certainly refuse to answer any questions from a random stranger. Hospitals, by the way, don't pay employees "under the table", let alone employees receiving benefits.

    According to the hospital's website all employees are eligible for benefits: medical, dental, vision...etc. It also addresses employee+children.
    I wouldn't have asked if I wasn't sure she was eligible.

    So what you're saying is that if the premium is $50-she pays $25 and my child support order is $25 less per month?

    Please answer the original question-If I find that she's working here, how do I request that her benefits cover the child?

    The order doesn't say anything about her paying it. It says I have to pay it when it becomes reasonably affordable. My job doesn't give benefits and won't any time soon, so if she has a job that will, she should have to use that in order to provide benefits, right? If so, how do I request this?

    The "order isn't really an "order" anyway-It's a proposed order and it's pretty vague. And NOWHERE did I say anything about "under the table" pay from a hospital...that makes me look like an idiot...obviously hospitals don't do that...if you're referring to another post where I talk about her having a nanny job "under the table" part time that wasn't included in the calculations for her income, that would make more sense.

    The termination was a general question. If the time of termination is something that needs to be established at the beginning when the order is first issued, obviously I need to go ahead and get on this, right? Makes sense.
    I'm not trying to terminate now...I didn't say anything about that.
