    Default Employer Pays Support When He Feels Like It

    My question involves child support in the State of: Kentucky

    First off My ex's employer is also the mayor. My ex has his support taken out of his paycheck. He gets paid bi-weekly. His boss pays whatever he feels like paying when he feels like paying. I've been to the courthouse and they tell me there is nothing I can do, because the father is technically paying his support. His boss being the mayor and all has a relationship with the entire courthouse (including the Family Court Lawyer). I have found out through alot of reseaching that the employer is supposed to send in payment within 7 days of it being withheld. There are months I go without getting any payment. My question is what can I do or who can I take this too because nobody in this city will help me?

    Contact the Ombusdsman of the Child Enforcement Agency. See if they can lean on the City in which your ex is employed to send in the payments timely, or seek sanctions as provided in the law against the city.

    I'm a little confused by your post though. In what capacity is your ex employed? Is he being paid by the mayor directly (like he works in his home and is paid by personal check?) or is he paid by the government like other city employees?

    Are you receiving all support that is owed to you, or not?

    The mayor owns his own business here. He works for him there. His boss(the mayor) actually runs the place... does hiring, firing, payroll, etc. He is the one who sends in the payments(when he actually does).

    Sometimes I get support sometimes I don't. It's coming out of his check. He has showed the case worker that it is being deducted from his check. His boss is just not sending it in as he should. And they say there is nothing they can do because he(my ex) is technically paying it.

    In your state, employers are mandated to send in child support payments no later than 7 days from the date it is withheld from the employees paycheck.

    Furthermore, under your states' laws, the employer will be held liable for the amounts if they are willfully not being deducted.

    Also be aware that his employer could be doing everything by the book, and it may be the State Disbursement Unit that is dropping the ball, causing you to be receiving late payments.

    It is also possible that his wages aren't high enough to withhold the full amount (or possibly any amount for that matter), depending on what net is available after taxes in any given pay period.

    ...Oh, and one more possibility. The state could be taking your support payments if you are receiving public assistance.
