    Default Non-Compete Agreement

    My question involves employment and labor law for the state of: Georgia

    I've signed a non-compete agreement for U.S. business with a company that's now going to focus on international business only. A "new" company has been formed to handle the U.S. business. I have not signed a non-compete for this "new" company.

    Since the original agreement was signed for the company moving overseas, and I've not signed an agreement with the "new" company handling U.S. business, is the original non-compete still legal if I went to work for a company that sells in the U.S. only?

    We cannot interpret the legality or enforceability of an agreement we have not read. You will need to have an attorney in your state review it.

    Georgia courts are extremely strict when addressing non-competes. They must be reasonably limited as to scope, time, and geographic restrictions. Also, Ga. courts won't "blue pencil," (change a clause) so if a clause violates the law, the entire provision is removed.

    However, you do need to take the agreement to an employment or contract attorney in your state for review & their opinion as to whether it is enforceable.
