My question involves labor and employment law for the state of: Illinois

A housekeeper was a no show for two shifts, coming to work the third day with papers from the police dept indicating he was in jail for two days after being arrested for aggravated battery. He has a court date. Clearly he has not been convicted (we don't hire felons).
I'm inclined to let him continue to work until the case is resolved one way or the other.

Any other suggestions?
