And CBG is exactly right on correct with the information she is giving. Honestly, this is not a battle that you are going to win. You can keep fighting it, but I doubt you will win.
BTW, even if you were NEVER eligible, the 401k company could still NEED your information for the required 401k plan testing that occurs each year...even if you were only there for 7 months and were never eligible.
I am sorry you are upset that they have personal information on you. It is scary to hear in the news when data is compromised. But there are perfectly legal reasons for your employer to share your data and this is one of them.
while I am not an attorney, I will say that I have considerable experience with this type of gray matter......public and private corporations generally sign up to a number of back-office services provided by the likes of TALX Network and others......these entities sell services for managing everything from 401k administration, workman's compensation, W-2 management, etc.....as a result the service providers are given carte blanc access to your personnel files including but not limited to payroll (depending on services provided)....well as you can imagine with data = power, these providers not only use this information to baseline salaries, but they also sell the information to network participants in the form employment verification or validation services.....so, while your issues surrounding 401k info is a very important issue relative to Privacy Rights......there's a greater disservice occurring here and that's corporations are becoming data sluts to these aggregation services and all of it is at the expense of the employee.....since this matter was exposed back in the early 2000s, many privacy rights firms and "consumer reporting" rights groups have attempted to put their arms around the matter.......successful? unsuccessful?.......who knows, but "The Man" is basically giving your employment data away in exchange for services..........
