    Default Paying Double Child Support

    My question involves child support in the State of: KS/MO

    I have been paying child support payments to the state of KS since September 2007. In Sept. 2007 I deployed to Afghanistan with the USAF. When I returned at the beginning of 2008, I had several letters from the state of Missouri, child support enforcement division.

    I called, and was informed that Missouri had involved themselves with enforcing my child support because my ex-wife was receiving cash assistance in missouri where she was living with her new boyfriend.

    Since my child support has been paid ON TIME from the beginning, Kansas SRS has never gotten involved with my child support case. It is strictly controlled by the court order, and my payments are made to the KS payment center.

    A little over a month ago, Missouri got a court ordered garnishment against my check, so $756/month started coming out of my check. And on top of that, my normal $502/month for kansas is still coming out.

    The $756/month to missouri is broken down as $502 for current support, and $254 for arrears support.

    There's 2 problems:

    1: I SHOULDN'T BE PAYING MISSOURI AT ALL.
    2: There is no arrears amount to be paid.

    All of the above is spawning from my ex wife who defrauded missouri, and then never provided information to them reguarding what months she received support for from kansas.

    So after all that, my question is....... WHAT CAN I DO??

    I'm at the end of my chain with this whole situation. My cell phone has now been shut off because of the severe lack of funds, and my rent hasn't been paid this month either....

    Hi. I'm not an attorney, nor am I writing to give you advice. I just wanted to say "wow". I am really sorry about what you're going through. My husband and I have been through the ringer with his greedy ex-wife and I am amazed at the courts decisions. I also have a child with my ex and have never been one that understands how some women feel that they are somehow entitled to every penny a man makes simply because they have a child together. I have never asked for or taken more than what is fair and it makes me sick to see situations like this (and like what we deal with every day with my husbands ex-wife). Reading your post makes me sad to know that you're out there serving your country (unless I am possibly misunderstanding your post) and this woman and the courts have the nerve to pull a fast one like this on you. Even the court should know better!

    You are correct in your assumption of me serving our country. I appreciate your post as well. Hopefully someone will be able to lead me in the right direction to get this all fixed, because as it stands right now, my ex-wife is making more money than I am. Which normally would be a "who cares" situation, but the problem is......SHE DOESN'T HAVE A JOB. And I work full time active duty USAF, as well as a part time job at a mechanic shop.

    Have you contacted base legal to have them help you prove to MO that your are paying and current with an order already issued is KS?

    Yes, and they weren't very helpful at all. Basically they looked at my stuff and sent me on my way...

    Contact the State Attorney's Office, senator, governor and as many of your state representatives as possible. You may find one who will be willing to help you. I certainly hope so. Be sure to have proof of what you are alleging. I think that it's absolutely disgusting of her to take advantage of you like that. Greed doesn't get anyone very far. It will all catch up to her one day. I'd like to know how she would feel if she had to pay all that back to you.

    I have been fighting for 22 years to collect for my daughter and the creep never, ever voluntarily made any payments. All payments (however few) were from unemployment benefits or wage garnishment (catch me if you can). So to see your ex take full advantage of you this way is truly disturbing.

    In the meantime, send out those letters, have them notarized if you have to. Good luck. Thank you for your great service to our country. My heart goes out to you.

    Ok, so here's an update on this horrific situation. I have now paid in $4,800 to the state of Missouri..... I am getting my kids finally, and they STILL are telling me that for them to discontinue the CS Garnishment, they will have to send my ex a letter, and she will have to agree to it. Even though I have shown them proof of all my KS CS payments, and I am going to have my kids.......
