    Question Waiting For Civil Demand In Massachusetts

    My question involves criminal law for the state of: Massachusetts

    Five months have past and I still did not received a civil demand letter or court date . I'm worried if the mail got lost but again should this type of letter require a signature on delivery? What are the chances that I still will receive anything from them ?

    Tks for your help!

    Ps: I tried to shoplift on amount of $140 from Tjmaxx and I'm first time offender. The cops were called but I was not arrested or received a citation.

    They have a year within which to do this.

    Go to the courthouse and ask if a case is filed against you.

    Far as Civil Demand contact the store ask for number of thier Civil Recovery service and then call

    I found this at the Court System site.....

    3) Upon the Commonwealth or any agency thereof by delivering a copy of the summons and of the complaint to the Boston office of the Attorney General of the Commonwealth, and, in the case of any agency, to its office or to its chairman or one of its members or its secretary or clerk. Service hereunder may be effected by mailing such copies to the Attorney General and to the agency by certified or registered mail.

    (4) Upon a county, city, town or other political subdivision of the Commonwealth subject to suit, by delivering a copy of the summons and of the complaint to the treasurer or the clerk thereof; or by leaving such copies at the office of the treasurer or the clerk thereof with the person then in charge thereof; or by mailing such copies to the treasurer or the clerk thereof by registered or certified mail.

    (5) Upon an authority, board, committee, or similar entity, subject to suit under a common name, by delivering a copy of thesummons and of the complaint to the chairman or other chief executive officer; or by leaving such copies at the office of the said entity with the person then in charge thereof; or by mailing such copies to such officer by registered or certified mail.

    Your not telling us anything we dont already know. Court and Civil Demand are seperate issues. One is the criminal case (court) The other is a Civil Action taken against you

    I'd look into it to see if anything's been filed, in case the mail got lost. Otherwise, it's of my OPINION that it's not your responsibility to make sure they punish you with the civil demand. I wouldn't go back to the store and ask about it or anything like that.

    Is that bad advice?

    If the lifter (intentional or not) gave the retailer false info and Civil demand went to wrong address will not matter. In fact the Civil recovery service could raise fine if no answer. If you think that might have happened contact store ask for number of thier Civil Recover service and call them. that will solve that problem

    The TJX companies have one (thats right one!) person to take care of all civil demand notices. Thats one person for every single Marshalls, TJMaxx, Homegoods, AJWright, etc. She is a very busy lady and sometimes things get backed up. It has been my experience that civil demand letters usually take at least 6 months to come. Keep waiting. If you never receive anything, be grateful, she was too busy to mail yours.

    You will probably not get anything from the courts if you haven't already.

    Also, TJX policy is if you're under 18, you don't get the civil demand, but everyone that work in the stores are required to have you sign the paperwork because on the same paperwork, it states that your info is submitted into a database called ChoicePoint. You should have gotten a copy of this (it's green).

    yes, im an adult and signed a couple papers including the green copy.
