    Default Seattle Speeding Ticket - Improperly Filled Out?

    I received the ticket in the City of Kenmore WA, for 51 in a 35.

    I intended to request a deferral, as the officer indicated this would be an option. However, when I was preparing to send the ticket in this morning with my response I noticed that there is no specific courthouse indicated. In other words, he forgot to check a box next to one of the courts at the bottom of the ticket.

    If I had to guess, I'd assume I should send it to Shoreline Courthouse as the ticket indicates the infraction was "in the district of Shoreline".

    However, I'm not sure this is a reasonable assumption.

    Obviously I am going to have to dig further in order to respond correctly...

    Would this be a violation of RCW 46.63.060 (e)?

    You can raise that argument in court, but in order to do that, you will have to identify the proper court yourself. Once you do that, the issue is probably moot. IRLJ 2.1 (b)(1) requires "The name, address, and phone number of the court where the notice of infraction is to be filed". As long as that information is on the form, it complies -- it may contain the names, addresses and phones of multiple courts, but as long as the information about the proper court is there, it still complies.

    RCW 46.63.060 (2)(e) requires "A statement of the options provided in this chapter for responding to the notice and the procedures necessary to exercise these options". This reference is to the requirement to explain about your options for responding (guilty, mitigated, contested) -- not the name of the court.

    So, if I were you, I'd phone the Clerks of the Courts and figure out where to send that response. Failure to do that WILL result in your license being suspended.

    I called, and was told by the automated telephone system that one "may respond to any King County district court".
