    Default Eviction Notice Delivered To Non-Existent 'Larry'?

    My question involves an eviction in the state of: Illinois

    My roommate had an issue where one month of rent last year didn't go through, so he called the main office and they told him to just pay one more month of rent for May. So, he went into the office today and they said it had already been sent to a collection agency and gave him a Notice of Termination of Tenancy. Apparently, this notice had been dated April 9th, 2008, and the Affidavit of Service is:

    I, "Tim XXX", being duly sworn, on oath depose and say that on the "10" day of "april", 2008, I served the within Notice to the tenant named therein by delivering a copy thereof to "larry"

    Signed "Tim XXX"


    Then the Notary Public signature line is blank. Everything in quotes above is everything in handwriting. The funny thing is, there is no "larry" living here, next door, let alone do we know any "larry." Also, all the handwriting is exactly the same. This "Tim XXXXX" is apparently our maintenance person who comes around to fix any damage.

    What are the laws concerning the actual receipt of delivery, who can serve this notice, etc? It's an official County document, but the only actual signatures on it are the Landlord Agent, and then the Affidavit of Service section all written by the maintenance guy.

    Shouldn't they at least have to get a signature? We've never known a Larry nor would anyone be here except the 2 of us to accept such a document. It should also be noted that this is the same maintenance person that also threatened us with thousands of dollars in criminal damages for holes in a wall in a room that we will be fixing before we leave.
