    Default Getting A "No Objection" Letter For A J1 Visa Waiver

    Hi I am a trainee here in USA and I have the 2 years residence required on my visa, in order to waive it I know I need to get a NO Objection letter from Goverment "Peru", but for getting that Letter, my goverment is asking me for a NO Objection letter from the sponsor of my program here in US. What happens is that my sponsor Cultural Homestay International doesn't want to issue that letter because they say it is not good look for the Department of State. My question: If my sponsor denies to give me that letter is there any way to make them issue that letter for me?, why they say it is not good look for the depatment of state?.... I will appreciate your answer!! - Thanks!!

    You can't force your sponsor to issue a "no objection" letter. As for why they are concerned about what the State Department may think, ask them.

    Hi again and Thanks for answerng me back.

    ...Well, it seems that my sponsor won't issue that letter for me while I am in this program, That is what I understood when they replied to me saying that they decided to issue such a letter once they get the confirmation that I am back in my home country. Anyways I told the peruvian gov. what is happenning with my sponsor and they just will take in account the emails they sent about this issue.

    ...Now I think that is solved in some point...

    Now I want to ask you something else, I am getting married with a US Citizen this month but also my boss offered me a Full time job (w/ salary) due he considers me an important asset to his fast growing company.

    Question: Should I apply to the No Objection letter from the US Department of State before or after I geet married???, in the beginning I wanted to apply for the change of my visa status from J1 to H1, but another lawyer told me I cannot apply anymore for the H1 visa because there is a window that closes each april and now it is so late.... What should I do??

    If you want to avoid the two year foreign residence requirement, you must get it waived. You can't circumvent the requirement through marriage.

    Are you with a attorney or are you doing all this by yourself? I'm also with a J1 visa and my visa expires on december this year (2008), me and boyfriend had talked about getting married but we want to know how much time do we have.
    Can I waived the two year foreign residence requirement after i get married or should i do before i get married?
