    Default Biological Father's Rights After Legal Paternity Is Established

    My question involves paternity law for the State of: TN

    My fiance and I started dating in October of last year. She was pregnant by another man. This man was verbally abusive and threatened her several times. She does have voice mail recordings and saved emails of his threats. We even filed a complaint against him with our local police dept and they told him to not contact her anymore or he would be arrested for domestic violence, intimidation and phone harrassment.

    Now the baby is 4 months old. At the time of her birth, the father was not around and wanted nothing to do with her. Since we were engaged at the time I signed the Acknowledgement of Paternity form. We are not married yet the wedding is planned for August 23 2008.

    Now he is threatening to take us to court for visitation rights after not speaking to us for almost 8 months now. Since I am, in the State of TN's eyes the legal father of our daughter, does he have any rights to bring this action against us now?

    He absolutely does and he absolutely should. What you and your girlfriend did was commit fraud AND perjury.

    Once paternity is established, this person she saw fit to have a baby with will be able to parent his child (minus your involvement). He will most likely be awarded joint custody, visitation and be ordered to pay child support.

    farmere, I recently posted to this forum for a similar reason, I want you to know that many of the posts here are from internet law junkies who don't actually know the law. So take everything said here as mere advice and don't let them get you down.

    The poster has been given accurate legal advice. The poster and his fiance have committed fraud and the biological father does have the right to challenge paternity and receive visitation/custodial rights.

    confused_mom is confused. She is in same situation where she thinks she can steal a mans child from him. She is also talking about fraud and deception. Her anger comes from fact we told her what she was attemtping to do was fraud and inmoral. I will agree talking to an Attorney is wise but the "real" Father has rights that the Mom can't take away just because she kicked him out of her bed
