    Default Landlord Says They Took Us To Court Twice And They Didn't

    My question involves an eviction in the state of: New Jersey

    We told landlord plenty of time about a strong marijuana smell, bugs, trash left in front of our door, broken bricks outside the apt building and nothing has been done. We with held rent and still nothing. We received a late payment notice in September and we paid that same day. Then in February we received a letter to evict if we didn't pay before a certain day and we did. So how is that being taken to court twice? Now we keep getting dnied for apts and we haven't even been evicted. I am nine months pregnant and I can not raise a baby in this apt...with the crime, trash and marijuana smell he'll never survive. What can we do to fix this please help.


    We went to this one property and was told we would be approved for the apartment upon landlord verification. Then we were told we had the apartment and that we could move in on May 8th. Today my boyfriend called to confirm our move in date and she said we didn't get the apartment. But we were told we had it and could move in on the 8th. We even went to see the apartment yesterday. The reason was because our current landlord told them that they took us to court twice which is untrue. We had late payments but never an eviction. How can we fix this? Sorry if its confusing we really just need help.

    Here's a suggestion.

    It may be late to undo this situation, just go look for another place. Make sure the next LL gets a "head's up" on your situation.

    Make it a legal issue would not help you quickly find another place.

    You can show the next LL you've been paying on time, except for two months, if you showed them the copies of cancelled checks. For the two months that you withheld, you can show you're a bit late, but justifiable.

    Some people bring all their pay stubs, copies of their credit report, cancelled checks for the rent, when they come to rent my place, and it all helps. And they also wear their Sunday best to make a good impression.

    It shows me they want to work with me.

    As a landlord, I've made exceptions for people who's been bankrupt, had problems with the prior LL, but told me upfront. I beleive that makes all the difference. I don't want to call the prior LL, and only find out then the guy is a troublemaker.

    One of my current tenants told me upfront he had fights with his landlord, which is why he's moving, but his mild demeanor was such that I thought his landlord was the troublemaker. I had him for 6 years now, pays the rent at least two days before the first, every month, and never made trouble for me. In fact, when he goes apple picking, brings me a load of apples.

    What helped him was he was up front with me.

    Thank you for answering. I try to tell my fianceto let them know why we withheld rent but he wants to give as little information as possible and I told him that will get us no where. I have no idea what else to do...our lease is up in july and this place is so disgusting that I don't even want to move into a different apartment in fear that it will be worse. Its so hard out here and all I want to do is live in a safe environment with my newborn and fiance. So the judgements will never leave? This is what I was afraid of.

    Have you contacted the Code Enforcement Department with your concerns?

    We were writing to The township. Where can we find the Code Enforcement Department for our township? And about the judgements...There is no way to get them off?

    Your phone book should have contact information for your township government, as should the township's website.

    I found it thank you. i am just so worried that these jugdements are going to be on my fiance's credit report and no one will want to sympathize with us. Its scary I really do not want to be here forever.

    Here's an idea.

    You'll go crazy each time you have a problem to try to figure out what department it is, and who to call. Then when you get hold of someone, you get transferred from one person to the other.

    For these problems, what I do is figure out who the councilman, alderman, or rep is for my area. Usually, they would tell you the particular person within the department, such as code enforecement, to call, and better yet, even sometimes make the call for you.

    If you grab hold of the "white pages" of the phonebook, you'll find a section in the back, listings for the Federal Government, then State, and finally local, the township. Then look up your local reps, in my case, the councilman for my district.

    I complained to my councilman on a few occasions, and I was surprised how quick I got action.

    Once people on my block was complaining about sanitation not picking up garbage when the garbage pail is too heavy. They called, and they got nowhere.

    I thought I called my councilman anyway, even on such a thing so ridiculous , and believe it or not, they called sanitation department, and sanitation called me back to apologize, and told me they're sending a specail truck just to my house, to pick up that one pail of garbage. The man wanted to know if I'll be home at 3:00PM, and I wanted to know why. He said he wanted to check back if the garbage was picked up, obviously to report back to the councilman.

    I bet you if your councilman, or local rep calls code enforecement, code enforcement will hop on it immediately. In my area at least, the "Buildings Department" is in change of code enforcement, and they've been criticized for lax oversight, and the last thing they want is the councilman getting on their case for another screwup.

    I find calling the my councilman, or the local paper, beats getting a lawyer every time, and it's free, and it's what looks good or bad that counts, not the law, and you get action in hours, not months, if ever.

    As to judgements, I suggest that if you look for a new place, say up front you have a dispute with the LL, but otherwise, you've been prompt.
