    Default Tenant Wants To Terminate Condo Rental

    My question involves landlord-tenant law in the State of: Washington.
    Recently (April. 20) I entered into an agreement with a tenant to rent my condo. She was obtaining assistance from the State Welfare system in efforts to assist her in the move in costs, the State Welfare verified and authorized payment by way of a check made out to me in the amount of 1/2 of all fees, leaving my tenant with a balance of the other half.

    Yesterday full payment was made by the tenant for the other half, she has had the keys to the condo since Apr. 20 and has moved some of her property in the home even though she herself has not resided in the home as of yet. The ulilities are now in her name all of which was done on the day she paid the balance, I advised her that there were a couple of items needing repair in the condo( light fixture) and that my husband would be there this weekend to complete that. Well I do not know if the young lady now suffers from buyers remorse, but she asked for a refund of all monies paid to date. Do we have any rights in this situation? Anyone please!!!!! help.

    You made an agreement its over. If you two agreed on lease term then she is accountable for rent until place is rerented. Now far as monies go that depends on much. She must give notice I will guess thats 30 days at least. So tenant owes rent for at least one month. Any deposits etc are returned "after" she vacates dwelling and you have inspected it for damages. You deduct any damages from deposit and return rest to both State and her. She will owe at least one months rent! You might also contact the state agency that sent you money as she might be up to no good. It would be wise to soncult a Landlord/Tenant Attorney as to your local laws. You should also seek to educate yourself on your local laws in this area if you plan to be a landlord

    Thank you for your help and great information. ANd your right this is alot harder than just renting a house out. So do I give her back her money even though she still has stuff in there? Again thank you so much.

    I did not say that. First was there a lease agreement? In other words was the rental month to month or was there a time like one year? She owes one month rent no matter what dead issue. She has no vacated until her belongins are out and keys returned. Once she vacates then do a walkthrough (with her is best) point out any damage (unlikely) itemize your costs to repair any damages or any cleaning needed provide copies of reciepts. Deduct those cost from deposit and return rest to both parties. State agency and Tenant. If she does not remove property ask her when she will? Remind her you cannot inspect home or consider dwelling vacated until she does.

    Sounds like the tenant is up to something fishy.

    I agree with you, something isn't right, but I did take your advice and contact the State Welfare Agency,spoke with the Supervisor and he stated that there is nothing she can do other than forfeit her rent. So again thank you, oh and to answer your question it is a month to month. She can have her full deposit back also.
