    Unhappy Parking Space Abuse

    My question involves landlord-tenant law in the State of: California

    4-plex has 6 parking spots. Each apartment is assigned 1 spot. One tenant rents an extra spot at $100 dollars a month. 2 other tenants habitually park in this extra spot. They have been asked many times to not park there but continue to do so.

    What can we do to ensure tenants not park in this extra space?

    Hi Aaron, "we" the landlords. Also, the abuse is not on the rented spot, the abuse is in the "free" unrented spot. The same tenants who abuse the "free" spot also leave their unattended cars in the main driveway for up to an hour at a time. Do we have grounds for an eviction?

    See CVC 22658 on towing vehicles from private property.

    You may want to talk to a lawyer about covering parking issues in your lease. What your current lease does or does not cover, I can't say.

    One way is to post signs saying all unauthorized cars will be towed, and make an arrangement with a towing outfit.

    The cheaper way is to put something in that spot so a car cannot be parked there. I would put a heavy picnic table, preferably chained down, so it would be too much work to move out of the way to park for a few minutes. You might put a sign on the picnic table, parking space available for $100/month.

    I had a similar problem in front of one of my buildings, but I cannot put a picnic table right off a public street, so I placed heavy planters there. I use that space if and when contractors come to do repairs, so I would just move the planters out of the way just before they come.

    Or you might think of something else that looks nice to put there.
