    Default Background Check, Employment And How Fast It Shows Up

    My question involves a background check in the State of: NY

    I'm going to be vague because I'm uncomfortable with giving too many details... but I'll give the info I can...

    Adult Child (over 18) was arrested and charged with Grand Larceny, Felony. Child is accused of stealing from job and was obviously also fired. This is a first offense and is a very good kid otherwise.

    In addition to the legal consequences that may be down the road, we as parents ARE making our child do a whole series of things. One of those is getting a job to pay for all the legal expenses. Our child has started filling out applications this week.

    What I want to know is how fast this may show up in a background check? Will the arrest record show? Will it only show if the child is convicted? Attorney will be working to get the charge down from the felony based on child's positive history and no priors, but what happens with background checks in the meantime? The incident has also been in local media -- do background check companies also draw info from there?

    Husband and I have always and want to continue to encourage honesty, but we also want our child to be able to be "rehabilitated" to be a productive citizen. Having no experience with any of this, we don't know what to expect or how to advise our child.

    Any help is appreciated! Thank you!


    ps. What is one of the better background check services on the internet? We'd like to keep an eye on this ourselves and are willing to pay the annual fee (as necessary) to do so...

    First, your child is not at 18 an adult child, they are adults. All backgrounds are not created equal and with so many companies that perform them it is impossble to say who is the best. Your son's charges will definetly show up and list any charges, convictions and the dispositions of those charges and/or convictions. Background companies only pull the information from local, state and federal courts.

    When your child fills out employment applications be sure they tell the truth re the questions asking about arrests/convictions. If they lie & the employer finds out (& they most certainly will on a background ck.), they will not hire or will fire them for sure for not being truthful.

    I'm aware of that. I was indicating that the adult in question is my child. Had I just said "my child" it leads the impression I'm talking of a minor... and no one says "my adult"

    Any idea how long information takes to show up on background checks?

    We fully intend to tell our child to be honest; However, often applications ask about convictions and not arrests. It is possible that the answer to the conviction question is "no" but the more detailed answer is "I've been charged and am waiting for the outcome" even if the application doesn't ask that. We have already communicated that if during the interview process there are questions about arrests and charges the answers should be honest, and include "I'm looking for someone to give me a chance to prove I am a good person..." we just don't know how to advise our child on being upfront from the application process since that status is in-between arrest and conviction.

    What information will show on a background check and how soon, depends entirely on what information the employer requests. There is no such thing as a standard "background check" in which all employers receive exactly the same information. If your child was arrested today, an employer who runs a background check tomorrow which includes arrest records will see it as soon as it works its way through the police computer - i.e., tomorrow. However, an employer who does not request arrest records will not see it.

    There IS no one answer.

    Is there a typical agency or government office that employers get their background information from? Do they go directly to the state/county or do they use 3rd party background check companies?

    Also, will the potential employers let my child know the results, or just not call back?... I realize it might be different from each business, but what is typical?

    We really want our child to get back on track for proof of good character... to both self and others... being unemployed isn't going to help anyone. Is it better to just stay away from bigger places more likely to do background checks, is it better to just be upfront from the get-go (maybe write a letter to attach to each application) or what? Anyone else face this situation themselves or with their child?

    Some employers check with the various agencies directly. Other employees use a background checking service.

    If they do direct contact, they may or may not get back to him. If they use a third party and they turn him down because of the background check, they are required by law to notify him.

    There is no norm.

    Keep in mind that information on internet background searches often take six months (or more) to appear.
