    Default Garbage Truck Hit My Fence

    My question involves a traffic accident in the State of: California

    About 4 months ago I went in my yard and found alot of damage to my fence, about 12- 16 feet of it knocked down. (we have an alleyway behind us) I went and talked to the neighboring businesses and the owners said that the Waste Management truck had hit the fence.
    So I called WM and they finally got back to me, came out, looked at the damage and said it could not have been them because they do not come through the alley.
    Since then I have taken 3 sets of pictures of their truck coming through the alley, and one set shows them backing up into the same spot they hit (and almost hit it again when I took the pics)
    I called the supervisor again, this time got a different guy, who was extremely rude to me ( I have his name and date I talked to him) and he said there was no way they did it because their trucks are not allowed to go in the alley.
    I have proof of course that this isn't true but they will not get back to me.
    What should I do? They did alot of damage, broke all the boards and the fence looks terrible!

    If they have a Small Claims Court in CA -- and the amount of the suit qualifies as "small claims", that's the route I'd take. You won't have an attorney, but neither will they. You have pictures debunking their story of "we don't go there", plus an eye witness. I'd say you've got a pretty good case. You'll also need estimates for how much it will cost to fix the fence -- at least two.
