    Default Statute Of Limitation

    My question involves collection proceedings in the State of: TX. My x-wife called last month and said a law firm in NY. had been calling about a credit card in her name that I had transferred some debt to while married. I told her that I would take care of it and called and made a 200.00 payment and told them I would make another payment in April. I called back in April and they said they filed a lawsuit. I looked @ the SOL for TX and it is 4 years. The law firm is saying since I made a payment that the SOL has restarted? My question is, since the acct. is in her name and I made the payment, does that restart the SOL? We have been divorced for almost 8 years and this is the first I have heard of this debt. The last payment she made on the acct. was in 2003.

    Making a payment on an account (no matter who pays) is going to restart the SOL clock.

    I agree - since a payment has been made, it is acknowledgment that the debt is owed & the SOL restarts.
