My question involves real estate located in the State of: FLORIDA
My husband purchased a house & almost 5 acres in 1968. The seller said the N property line was a fence which runs E from HWY to W end of property. The fence has never been anything other than a division between property -it has never been an enclosure.

Also another house -he did not purchase-sat South of the fence line.
In 1974, he purchased the house and removed it-leaving foundation.

We wanted to replace fence and had a survey done. The survey placed the N property line 7 (near HWY) - 14 ft (West end) South of fence.
This line also runs in middle of old house foundation.
Property owners N of fence line HAVE INHERITED- NEVER MAINTAINED UNDEVELOPED LAND. They refuse to give up and quit claim. They want to steal our strip of land-which we have maintained since 1968.
CAN WE STAND ON THE PREMISE THAT THE FENCE WAS NOT AN ENCLOSURE- BUT A BOUNDARY AND NOT BE HELD TO SAME STANDARD AS FENCE?
