My question involves adoption law for the State of:Wisconsin. My son just turned 3 and his father has only been involved in his life for about 5 months, about 2 months when he was born and 3 months just a few months ago. He also owes about 5000 in back child support and also 5000 to the state.And the child support agency issued a warrant for his arrest and this is the second time. He was in prison right before I met him, then he said that he wanted a paternity test, but then skipped it and disappeared for 2 years while on parole! He is off of parole, but has the horriable record and I know that he is always doing drugs. Now he no longer lives in WI and now lives about half way across the country, he doesn't try to contact him at all or anything!!! Now I am engaged and my fiance wants to adopt my son, my fiance is the only father he knows. We aren't getting married for a year! I guess I have a couple of questions... Do we have to be married before my fiance can adopt my son? And do I have to get my sons bio-father to sign over his rights before my fiance can adopt him? If I have to get him to sign over his rights then how can I get him to? I know he is an un-fit father, and he told me that he never wanted kids, but how can I prove it to courts and whoever else I have to. Also will his past have any impact on anything if it does go to courts???Please HELP!!!
